Terms of Service

These Terms of Service ("Terms") govern your access to and use of Market Mavericks, MAV, marketmavericks.org, and any related websites, applications, dashboards, trade journal tools, artificial intelligence features, market intelligence features, subscription services, content, and services offered by Market Mavericks ("Market Mavericks," "MAV," "we," "us," or "our").

By accessing or using MAV, creating an account, starting a subscription, or clicking to accept these Terms, you agree to these Terms. If you do not agree, do not use MAV.

These Terms include and incorporate our Privacy Policy, Cookie Policy, Risk Disclosure, and any additional terms presented to you in connection with specific features or subscriptions.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use MAV. By using MAV, you represent that you meet this requirement and have the legal authority to agree to these Terms.

You may not use MAV if you are prohibited from doing so under applicable law, sanctions rules, broker rules, exchange rules, or other restrictions.

What MAV does

MAV is a software platform designed to help traders journal trades, review analytics, monitor market information, organize strategies, track goals, evaluate risk, and receive educational AI-assisted feedback based on trade journal data.

MAV may include features such as:

• Trade journaling.
• CSV trade imports.
• Dashboards and analytics.
• P&L calendar and heatmaps.
• Risk management tools.
• Market news and sentiment labeling.
• AI coach and journal analysis.
• Strategy/playbook documentation.
• Goals, challenges, and performance review tools.
• Subscription-based feature access.

MAV is not a brokerage, exchange, investment adviser, broker-dealer, futures commission merchant, commodity trading advisor, tax adviser, law firm, or accounting firm.

No financial advice

MAV is provided for informational, educational, journaling, and analytics purposes only. MAV does not provide financial, investment, legal, tax, accounting, or other professional advice.

Nothing in MAV is a recommendation to buy, sell, hold, short, or trade any security, futures contract, cryptocurrency, option, foreign exchange instrument, commodity, or other financial product.

You are solely responsible for your trading decisions and financial outcomes. Before making financial decisions, you should conduct your own research and consult licensed professionals as appropriate.

Your use of MAV is also subject to our Risk Disclosure.

Trading risk

Trading and investing involve substantial risk of loss. You may lose some or all of your capital. Past performance, backtests, simulated results, win rates, P&L, AI outputs, sentiment labels, journal analysis, examples, screenshots, or sample data do not guarantee future results.

You agree that Market Mavericks is not responsible for your trading losses, missed opportunities, tax consequences, broker decisions, execution outcomes, risk management choices, or reliance on any information available through MAV.

AI features

MAV may use artificial intelligence systems, including third-party AI providers, to generate summaries, insights, sentiment labels, pattern analysis, journal feedback, and conversational responses.

AI-generated outputs may be inaccurate, incomplete, outdated, misleading, or inappropriate for your circumstances. You are responsible for independently verifying any AI-generated output before relying on it.

You agree not to use AI outputs as the sole basis for any trading, investment, legal, tax, or financial decision.

Account registration

To access certain features, you may need to create an account. You agree to provide accurate information, keep your login credentials secure, and promptly update your account information if it changes.

You are responsible for all activity under your account. You must notify us immediately if you believe your account has been compromised.

We may suspend or terminate your account if we believe you violated these Terms, created risk for MAV or other users, failed to pay fees, abused the service, or used the platform unlawfully.

Subscriptions, billing, and cancellation

Certain MAV features may require a paid subscription. Subscription prices, billing periods, plan limits, trial terms, renewal terms, and included features will be disclosed at checkout or on the pricing page.

Unless otherwise stated, subscriptions renew automatically until canceled. By subscribing, you authorize us and our payment processor to charge your selected payment method for recurring fees, applicable taxes, and any other disclosed charges.

You may cancel your subscription through your account settings or by contacting support at support@marketmavericks.org. If you cancel, you will generally retain access until the end of your current billing period unless otherwise stated.

We may change plan features, pricing, or billing terms with notice as required by law. If you do not agree to a change, you should cancel before the change takes effect.

Refund policy

Unless required by law or expressly stated in a separate refund policy, subscription fees are non-refundable and cancellations do not result in prorated refunds.

If you believe you were charged in error, contact support@marketmavericks.org within 30 days of the charge. We may review refund requests at our discretion.

Beta features and product changes

MAV may offer beta, experimental, preview, or early-access features. These features may be incomplete, unstable, unavailable, changed, or discontinued at any time.

We may add, modify, suspend, or remove features, plan limits, integrations, providers, or functionality at any time. We are not liable for any loss or inconvenience caused by changes to the service.

User content and trade data

You may upload, enter, import, store, or generate content in MAV, including trade data, journal notes, screenshots, CSV files, strategy notes, goals, comments, settings, and prompts ("User Content").

You retain ownership of your User Content. You grant Market Mavericks a limited license to host, store, process, display, analyze, transmit, and use your User Content as necessary to provide, secure, maintain, improve, and support MAV.

You represent that you have the right to upload and use your User Content and that doing so does not violate any law, contract, broker policy, exchange rule, privacy right, intellectual property right, or third-party right.

Do not upload sensitive personal information unless necessary to use the service. Do not upload information you are not allowed to share.

Third-party services

MAV may rely on third-party services for hosting, database storage, authentication, payments, analytics, market data, news, AI processing, email, logging, and other functions. These providers may include services such as Supabase, Stripe, Anthropic, Finnhub, Railway, or other providers.

Third-party services may be subject to their own terms, privacy policies, limitations, outages, and data practices. We are not responsible for third-party service failures, data inaccuracies, downtime, or changes.

MAV may contain links to third-party websites or services. We are not responsible for third-party content, policies, or practices.

Acceptable use

You agree not to:

• Use MAV for unlawful, harmful, fraudulent, abusive, or deceptive purposes.
• Use MAV to provide regulated financial, investment, legal, or tax advice without proper authorization.
• Misrepresent MAV outputs as guaranteed results, official recommendations, or licensed advice.
• Reverse engineer, scrape, copy, resell, or exploit MAV except as permitted by law.
• Interfere with, disrupt, overload, or attack MAV or its infrastructure.
• Attempt to access another user's account or data.
• Upload malware, harmful code, or content that violates third-party rights.
• Circumvent plan limits, payment requirements, security controls, or usage restrictions.
• Use MAV to train competing AI models or create a competing product without written permission.

Intellectual property

MAV, Market Mavericks, the website, app, software, designs, logos, trademarks, content, features, workflows, analytics layouts, and related materials are owned by Market Mavericks or its licensors and are protected by intellectual property laws.

Except for your limited right to use MAV under these Terms, we do not grant you ownership of any intellectual property in MAV.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from MAV without our written permission.

Feedback

If you send us feedback, suggestions, ideas, bug reports, or feature requests, you grant us the right to use them without restriction or compensation to you.

Privacy

Our Privacy Policy explains how we collect, use, share, and protect personal information. By using MAV, you acknowledge our Privacy Policy.

Disclaimers

MAV is provided "as is" and "as available." To the maximum extent permitted by law, Market Mavericks disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation.

We do not warrant that MAV will be accurate, reliable, profitable, secure, error-free, uninterrupted, or suitable for your needs.

Limitation of liability

To the maximum extent permitted by law, Market Mavericks and its owners, officers, employees, contractors, affiliates, providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for trading losses, lost opportunities, lost data, lost revenue, business interruption, reputational harm, or cost of substitute services.

To the maximum extent permitted by law, our total liability for any claim related to MAV or these Terms will not exceed the amount you paid to Market Mavericks for the service during the three months before the event giving rise to the claim, or $100, whichever is greater.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Market Mavericks and its owners, officers, employees, contractors, affiliates, providers, and licensors from any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• Your use of MAV.
• Your trading or financial decisions.
• Your User Content.
• Your violation of these Terms.
• Your violation of law or third-party rights.
• Your misuse of AI outputs, data, analytics, or platform features.

Termination

You may stop using MAV at any time. You may cancel your subscription through your account settings or by contacting support.

We may suspend or terminate your access to MAV at any time if we believe you violated these Terms, created risk, failed to pay, abused the service, or if we discontinue the service.

After termination, provisions that by their nature should survive will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute provisions.

Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, unless applicable law requires otherwise.

Dispute resolution

Before filing a formal claim, you agree to contact us at support@marketmavericks.org and try to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms, updating the effective date, emailing you, or using another reasonable method.

Your continued use of MAV after changes become effective means you accept the updated Terms.
